New Domicile Law of J&K Released? Check Who is Eligible to Apply for Govt. Jobs in J&K


You all know that after the abrogation of Article 370, permanent residents of Jammu and Kashmir, lose their special status, as provided to them Under Article 35-A. The special status allows that Govt. Jobs in J&K will be given only the residents of Jammu and Kashmir. However, after 5th August, PRC gets invalid and J&K loses its special status. 

On 1st April 2020, Ministry of Home Affairs, Govt of India has issued the New Domicile Law for J&K.  Ministry of Home Affairs orders adaptation of Jammu and Kashmir state laws to be called as Jammu and Kashmir Reorganisation (Adaptation of State Laws) Order, 2020. It shall come into force with immediate effect. This means that New Domicile Law in J&K will be applicable from 1st April 2020.


What is the New Domicile Law-2020 for J&K?




According to the new domicile law :

1) The person, who has resided in J&K for a period of 15- years are eligible to become a resident of J&K

2) A student who has studied for a period of 7 years Or has passed 10th or 12th Class from any State Board OR CBSE school in J&K is a resident of Jammu and Kashmir.

3) “The person, who is registered as a migrant by the Relief and Rehabilitation Commissioner (Migrants) in J&K, will also eligible for a resident of J&K

Apart from this, Children's of below mentioned Govt. Officials who have served in Jammu and Kashmir for a period of 10 years are also eligible to be residents of Jammu and Kashmir

1) Central Govt. Official
2) All India Services, Officers,
3) Officers of PSU's & Autonomous body of Central Govt.
4) Public Sector Banks
5) Officials of Statuary bodies, 
6) Officials of Central University and Research Institutes.

Section 5(A) : Section 5A states that no person shall be eligible for appointment to a post carrying a pay scale for not more than level 4 “unless he is a domicile of UT of J&K.”

This means New Residents will be eligible to apply for Gazetted and Non-Gazetted Posts, but not for Class IVth posts.

Who will Issue the Domicile?


As per the provisions of New Domicile Law of J&K, Tehsildar is designated govt. person to Issue the Domicile. So, you have to visit your Tehsil Office and get the Domicile Issued. 

Applicants should note that without Domicile Certificate, you cannot apply for Government Jobs in J&K.

In case your are getting difficulty in obtaining the Domicile, even after fulfilling all the conditions of residence, you can appeal to the Deputy Commissioner for providing an opportunity of being heard within 60 Days.
